These Terms and Conditions (“Terms”) govern your use of the website https://aracarifoundation.org and your participation in any retreats, events, sessions, or services provided by Aracari Foundation (“Aracari,” “we,” “us,” or “our”).
By accessing our website or registering for any Aracari program, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use our website or services.
Aracari Foundation is a nonprofit organization registered in the Republic of Panama under Folio No. 25063907, focused on cultural preservation, ancestral wisdom, and educational programs for personal development.
You must be at least 18 years old to participate in our retreats and services. By using our website or registering for any event or retreat, you represent that you meet this minimum age and have the legal capacity to enter into a binding contract under applicable law. We do not make exceptions to these age requirements.
Our retreats, ceremonies, and related activities are intended solely for spiritual and personal development, cultural learning, and self‑exploration.
They do not constitute and are not a substitute for:
Medical treatment
Psychological or psychiatric care
Professional counseling, therapy, or any licensed health service
We do not provide medical diagnoses, prescribe medications, or offer emergency medical services. You are solely responsible for your physical and mental health before, during, and after participation.
Before attending a retreat or ceremony, you may be required to complete an intake and/or medical questionnaire and may be asked to disclose:
Medical history (physical and mental health conditions)
Current and recent medications, supplements, or substances used
Prior experiences with altered states of consciousness
You agree to:
Provide complete, honest, and accurate information.
Inform us of any changes in your health or medication before the retreat.
We reserve the right, at our sole discretion, to decline your participation, require additional medical documentation, or remove you from a retreat if we believe participation may endanger your safety or the safety of others.
Participation in spiritual and personal development retreats, including ceremonies that may involve traditional ancestral practices, carries inherent physical, emotional, psychological, and spiritual risks, which may include but are not limited to:
Intense emotional experiences
Psychological distress or resurfacing of memories
Physical discomfort, nausea, or other bodily reactions
Unpredictable or challenging experiences during and after the retreat
By choosing to participate, you:
Acknowledge and understand these risks.
Assume full personal responsibility for any outcomes, effects, or consequences arising from your participation.
Voluntarily release Aracari Foundation, its directors, officers, facilitators, staff, volunteers, and affiliates from any claims, liabilities, or damages (to the extent permitted by applicable law), arising from your participation, except where caused by our gross negligence or intentional misconduct.
Participation in all activities, ceremonies, and sessions is entirely voluntary. You have the right to decline to participate in any specific activity or request to stop your participation at any time. Choosing not to participate, or to withdraw early, does not automatically entitle you to a refund.
To maintain a safe, respectful, and sacred environment, you agree to:
Refrain from using alcohol, recreational drugs, or contraindicated substances before and during the retreat, as instructed by Aracari.
Follow all preparation guidelines provided, including dietary recommendations.
Comply with the instructions of facilitators and staff.
Treat other participants, staff, and local communities with respect and non‑violence.
Maintain confidentiality regarding the personal experiences of other participants.
We reserve the right to remove any participant from a program or premises, without refund, if their behavior is unsafe, disruptive, disrespectful, or violates these Terms.
9.1 Bookings and Payments Retreat and event bookings are confirmed only after we receive the required deposit or full payment. Payments are processed via Stripe or other secure payment methods displayed at checkout.
9.2 Cancellation Policy
More than 60 days before retreat start: Refund of 75% of amounts paid, or option for credit toward a future retreat, subject to availability.
Between 30–59 days before retreat start: Refund of 50% of amounts paid, or option for credit toward a future retreat, subject to approval.
Between 15–29 days before retreat start: Refund of 25% of amounts paid.
Less than 14 days before retreat start or no‑show: No refund.
Credits may be considered only in exceptional circumstances, at our sole discretion, and may require documentation. All refunds are processed to the original payment method, minus any non‑recoverable transaction fees.
9.3 Credits In some situations, we may, at our discretion, offer a credit toward a future retreat rather than a cash refund. Conditions, validity period, and transferability of credits will be specified at the time they are issued.
We may need to modify, postpone, or cancel a retreat, event, or service if circumstances beyond our reasonable control occur (e.g., natural disasters, pandemic restrictions, or unavailability of key facilitators). In such cases, we will offer to transfer your booking to a rescheduled date or offer a refund of retreat fees paid. We are not responsible for independent travel expenses (flights, insurance, etc.).
Donations made to Aracari Foundation are generally non‑refundable, except in cases of clear payment error or fraud. For questions, contact us at [email protected].
All content on https://aracarifoundation.org is owned by or licensed to Fundacion Aracari. You may use materials for personal, non‑commercial use only.
We will only publish testimonials or identifiable photos of you with your explicit consent. If you wish to withdraw permission for future use, contact us at [email protected].
Our website may contain links to third‑party websites (e.g., Stripe, partners). We are not responsible for their content or privacy practices.
To the fullest extent permitted by law, Aracari Foundation shall not be liable for indirect or consequential damages. Our total liability is limited to the amount paid for the specific service. You agree to indemnify and hold harmless Aracari Foundation from claims that come out of your violation of these Terms or misuse of our services.
The laws of the Republic of Panama govern these Terms. Any dispute shall first be addressed through good‑faith discussions. If unresolved, it shall be submitted to the exclusive jurisdiction of the courts of Panama City, Republic of Panama.
