These Terms and Conditions (“Terms”) govern your use of the website https://aracarifoundation.org and your participation in any gatherings, events or activities provided by Aracari Foundation (“Aracari,” “we,” “us,” or “our”).
By accessing our website or registering for any Aracari program, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use our website or programs.
Aracari Foundation is a nonprofit organization registered in the Republic of Panama under Folio No. 25063907, focused on cultural preservation, ancestral wisdom, and educational programs for personal development.
You must be at least 18 years old to participate in our gatherings and events. By using our website or registering for any event or gathering, you represent that you meet this minimum age and have the legal capacity to enter into a binding contract under applicable law. We do not make exceptions to these age requirements.
Our events and related activities are designed exclusively for spiritual and personal growth, cultural enrichment, and self-discovery.
They do not constitute and are not a substitute for:
Medical treatment
Psychological or psychiatric care
Professional counseling, therapy, or any licensed health service
We do not provide medical diagnoses, prescribe treatments, or offer emergency medical services. You are solely responsible for your physical and mental health before, during, and after participation.
To ensure a safe environment for all, before attending a program, you may be required to complete a confidential intake form and may be asked to disclose:
General health status (physical and mental well-being).
Current and recent prescriptions or supplements used.
Prior experiences with intensive introspective, somatic, or meditative practices.
You agree to:
Provide complete, honest, and accurate information.
Inform us of any changes in your well-being or routine before the program.
We reserve the right, at our sole discretion, to decline your participation, require professional clearance, or remove you from a program if we believe participation may endanger your safety or the safety of others.
Participation in our immersive cultural and educational programs, including activities involving deep introspection and somatic work, carries inherent physical, emotional, and psychological elements. These may include, but are not limited to:
Deep emotional processing or catharsis.
Psychological shifts or resurfacing of memories.
Somatic release, energetic shifts, or physical sensations.
Unpredictable or challenging internal experiences during and after the program.
By choosing to participate, you:
Acknowledge and understand the nature of this experiential learning.
Assume full personal responsibility for your well-being and any outcomes arising from your participation.
Voluntarily release Aracari Foundation, its directors, officers, facilitators, staff, volunteers, and affiliates from any claims, liabilities, or damages (to the extent permitted by applicable law) arising from your participation, except where caused by our gross negligence or intentional misconduct.
Participation in all programs and activities is entirely voluntary. You are free to decline participation in any specific activity or request to stop your participation at any time. However, choosing not to participate, or withdrawing early from a program, does not entitle you to a return of contributions or credit.
To maintain a safe, respectful, and harmonious environment, you agree to:
Refrain from using alcohol, recreational substances, or non-compliant items before and during the activities, as instructed by the Aracari Team.
Follow all preparation guidelines provided, including dietary recommendations for cultural and energetic sensitivity.
Comply with the guidance of facilitators and staff at all times.
Treat other participants, staff, and local communities with respect, dignity, and non‑violence.
Maintain strict confidentiality regarding the personal stories and experiences of other participants.
We reserve the right to remove any participant from a program or premises, without return of contribution, if their behavior is unsafe, disruptive, disrespectful, or violates these Terms.
9.1 Registration & Contributions Participation in our educational programs is confirmed only after we receive the program contribution. These contributions are essential donations that cover basic logistical expenses, support our facilitators, and sustain the foundation's cultural preservation mission. Contributions are processed via wire transfer or other secure methods displayed at checkout.
9.2 Withdrawal & Contribution Retention Because our programs rely on planning and financial commitments to local communities and venues, funds are allocated shortly after receipt. Therefore, in the event of withdrawal:
More than 60 days before the start date: 75% of the contribution may be returned, or offered as a credit for a future program, subject to availability.
Between 30–59 days before the start date: 50% of the contribution may be returned, or offered as a credit, subject to approval.
Between 15–29 days before the start date: 25% of the contribution may be returned.
Less than 14 days before the start date or absence: The contribution is non-refundable and will be considered a full donation to support the Foundation’s ongoing projects.
Credits may be considered only in exceptional circumstances, at our sole discretion, and may require documentation. All reimbursements are processed to the original method, minus any non-recoverable transaction fees.
9.3 Reallocation of Contributions (Credits) In some situations, we may, at our discretion, allow a contribution to be reallocated toward a future educational program rather than a monetary return. Conditions, validity period, and transferability will be specified at the time they are issued.
We may need to modify, postpone, or cancel a scheduled program if circumstances beyond our reasonable control occur (e.g., natural disasters, pandemic restrictions, or unavailability of key facilitators). In such cases, we will offer to transfer your registration to a rescheduled date or offer a return of the contribution. We are not responsible for independent travel expenses (flights, insurance, etc.).
Donations and contributions made to Aracari Foundation are considered final to support our mission and are generally non‑refundable, except in instances of proven processing error or duplicate entry. For inquiries, please contact us at [email protected].
All cultural and educational content on https://aracarifoundation.org, including text, imagery, and logos, is owned by or licensed to Fundación Aracari. You may access and use these materials for personal, non‑commercial, and educational use only.
We respect your privacy. We will only publish participant stories, reflections, or identifiable photos of you with your explicit consent. If you wish to withdraw permission for future use, please contact us at [email protected].
Our website may contain links to third‑party websites, collaborators, or external resources. We are not responsible for the content, privacy practices, or availability of these external sites.
To the fullest extent permitted by law, Aracari Foundation shall not be liable for indirect, incidental, or consequential damages. Our total liability is strictly limited to the contribution amount associated with the specific program or activity. You agree to indemnify and hold harmless Aracari Foundation from any claims arising from your violation of these Terms or your participation in our programs.
The laws of the Republic of Panama govern these Terms. Any dispute shall first be addressed through good‑faith discussions. If unresolved, it shall be submitted to the exclusive jurisdiction of the courts of Panama City, Republic of Panama.
